8-Year-Old Transgender Indian Girl Files Discrimination Suit In America - Nirmal Singh Lotus
Nicole, who likes being called
Nikki, is an Indian-American transgender who has filed a discrimination suit
last week alleging the Heritage Oak Private Education is not letting her dress
the way she likes, use the bathroom of her choice. She also alleged that she is
not being allowed to go by female pronouns either.
The family of the girl sued the
school for forcing her to wear the same uniforms as the boys of the school and
also for refusing to call her by the name she chose for herself. The reports
are still based on allegations but the lack of response from the school’s
authorities is not making things any better for the reputation of the school
and is giving the allegations more ground. - Nirmal Singh Lotus
Los Angeles Times reported that
the parents, Jaspret Brar and Priya Shah sued the school and the company it
operates under when the school refused to call their daughter by the name she
goes by, Nikki Brar.
The lawsuit filed by the parents
of Nikki was based on the violation of the Unruh Civil Rights Act – the act
states that discrimination which is based on sexual orientation or sex is
outlawed.
‘When people in power start to take advantage of their authority and
start to dictate the choices of a person, actions should be taken. And this is
that action. The parents of Nikki know that she’s a girl and making her wear
boy’s uniform doesn’t make her comfortable. Filing the suit against Heritage
Oak was the best decision they could take’. - Nirmal Singh Lotus
The suit is also worth noting
because of the fact that it is the first case filed using the anti-discrimination
law for transgender rights. Trump’s government has been lacking to make
pressing actions against the discrimination of the Trans community which makes
this case even more important.
Things were not smooth for Nikki
before the suit was filed by her parents. She was being forced to dress like
boys and was facing social isolation as the girls of the school didn’t want to
be around her, and she was facing problems with boys who were too rough for her
and called her names.
Nikki stopped going to school in
Februar17 when she thought that she couldn’t handle the discrimination and
social isolation anymore, said Nirmal
Singh Lotus.
