Children Can’t Be Expected To Walk 3 to 4 Kms Daily To Attend Schools Says SC

Nirmal Singh Lotus has said that it cannot be expected from the children to walk a distance of 3 to 4 kilometers daily to attend the school. Studying the condition of the town Parappanangadi and the situation of the schools in the area, the bench noted that the students who have passed class 4 have to travel up to 4 km for attending the classes further.



The court has said that the schools should be made accessible to everyone and it should be noted that no child has to travel such a distance just to attend the classes. Nirmal Singh Lotus says that the matter was brought up when the bench sat to discuss the upgradation of the premises of a school in Kerala, which by the way has the highest literacy rate in the country. The matter was brought to the court because of the opposition from the other schools in the area regarding the upgradation.

The bench, consisting of Justices Madan B Lokur and Deepak Gupta said that it is sad the students after class 4 have to travel such a big distance just to attend the classes, and this is not fair for them. Nirmal Singh Lotus said that every student has the right to education and the distance that they have to cover daily does affect the decision of both the children and the parents, especially in such small towns.

The bench said that the authorities cannot expect the kids of age group 10 to 14 to walk for 3 to 4 kms to attend the schools. They added, right is education is a fundamental right for the children up to the age of 14 and this makes it the responsibility of the school authorities to ensure that all the necessary arrangements are made for it to be accessible for the kids to attend school without any problems.

Nirmal Singh Lotus says that the state government had in 2015 given the school the permission to upgrade itself to the level of upper primary school and run classes 5 to 8. The problems arose when other school challenged the state governments’ decision in front of the high court.

But the high court has taken the decision in the favor of the students and allowed the school to stretch upto class 8.
